McAlester - Child rapist gets one year

Here is a sad story out of McAlester. On Wednesday, 64-year-old David Harold E. Earls, pleaded no contest to charges of rape and sodomy of a 5-year-old girl, and was sentenced to one year in prison.

Apparently the little girl did not qualify as a witness, and rather than lose the conviction all together they let Earls plead out.

Here is what Assistant District Attorney Mike Miller had to say about the deal.

We couldn’t keep her (the victim) in the chair long enough to get the questions out of her

We thought it was better to take a plea bargain to secure a conviction rather than risk not getting a conviction at all based on (the victim’s) inability to testify.
Earls will get one year in prison, and then be required to register as a level 3 sex offender, which will require him to verify his address every 3 months.

It's disconcerting that this had to happen, but I understand the prosecutor's unwillingness to let him get off scott-free. Sad news all the way around.

Maybe justice will be served and the guy will get gang raped while in prison.

Oh, believe me! The year that this guy serves will feel like 30. The general prison population does not look too kindly on child rapists

David Harold Earls molested me for approx 3 yrs when i was 6-9 yrs old. I am now 43. He is the devil and will do it again when he is released. Until we start putting away garbage like this for good, we can expect more of the same. My heart breaks for this child. God will take care of David Earls.

That judge should have never put that child within sights of that P.O.S... She sould have been protected at every cost, wasnt she violated enough. What is the use of "Childs Advocacy Groups"? Surely if you have the degree and experience to become a Judge or D.A. you can come up with a safer legal way to qualify a child as a witness other than traumatizing them by intimidation of the rapest. Maybe she would have been able to qualify if she wouldnt have been scared to death of him and having him stare her down as she tried to anwser the questions asked.

For the one who thinks the 1 year is going to be hard on him! Keep dreaming my friend. These people get separated from those who would do harm to the sex offenders. Just another way the Liberal's like to protect the disgusting criminals.

Why couldn't they do video testimony?? I just don't understand how this can happen in this day and age.
